The 2010 National Fat-Loss-A-Thon is a competition providing a program on health, fitness and nutrition; winners will be judged on both improvements to physical appearance and self-improvement.
The competition will be conducted in Australia and entry is open to all residents of Australia.
Entries open 9am EST on Tuesday 29 December 2009 with the first official start date for the competition being Friday 1 January 2010; entrants are permitted to upload their before photos up to 72 hours prior to their actual selected start date and time of the competition.
Last entries will be accepted up to and including 5pm EST on Sunday 7 March 2010, however participants entering within 72 hours of the competition closing must select a competition start date up to and including Sunday 7 March 2010.
Each entrant is required to complete the competition in 12 consecutive weeks from their selected start date and no changes or exceptions will be permitted.
Winners will be notified by registered post to be sent on Monday 21st June 2010.
To enter, all sections of the online ‘pre’ and ‘post’ entry forms found at www.fatlossathon.com must be completed. All answers must be your own, original account and written in English.
Incomplete entries will be disqualified.
Before photos must be taken and uploaded on-line anytime from 72 hours prior to the date and time of actually beginning the Fat-Loss-A-Thon competition; photos must be uploaded at the same time as submitting the online pre-competition entry form.
After photos must be taken and uploaded on-line within 72 hours of finishing the competition and must be uploaded at the same time as submitting the online post-competition entry form.
Real Body Enterprises Pty Ltd will not be responsible for lost, late, illegible, or un-received entry forms or entries not finalized due to any technical issues or encounters.
All entries will be judged by a panel from Real Body Enterprises Pty Ltd and The Sports Rewards Foundation Ltd and will be based on the following criteria:
- Improvements to physical appearance based on the before and after photos (a 50% weighting will apply to this criteria)
- Self-improvement based on written responses to competition questions (a 50% weighting will apply to this criteria)
All participants must be at least 18 years of age before starting the 2010 National Fat-Loss-A-Thon Competition.
The 2010 National Fat-Loss-A-Thon Competition is subject to applicable federal and state laws.
Employees of Real Body Enterprises Pty Ltd and all affiliates or contractors who are directly or indirectly involved in the contest, as well as their immediate family members may participate, however they are not eligible to win.
By participating in the 2010 National Fat-Loss-A-Thon Competition, you agree to accept these Official Rules and the decisions of the judges, whose decisions are final and binding in all respects.
By entering the 2010 National Fat-Loss-A-Thon Competition, you also agree to release, discharge and hold harmless Real Body Enterprises Pty Ltd and all affiliates or contractors, and their respective officers, directors, employees and agents, from any and all damages whether direct or indirect, which may be due to or arise out of participation in the contest or the acceptance, use/misuse or possession of a prize.
All federal, state and local laws and regulations apply. Void where prohibited by law, rule or regulation.
The 2010 National Fat-Loss-A-Thon Competition participants may not use anabolic steroids or any strength-enhancing prescription drugs or medications unless prescribed by a physician to treat an existing medical condition (medication and medical condition must be noted on your pre-competition entry form).
Real Body Enterprises Pty Ltd reserves the right to interpret these rules and, if necessary, to amend the rules at its sole discretion and without notice to individual participants.
Any amendments to the rules or changes in prizes will be published online at www.fatlossathon.com - any amendments in these rules will be highlighted by the use of blue italic writing.
Rule interpretations and all judging decisions are final. All information and materials submitted along with your Official On-line Entry Forms become the sole and exclusive property of Real Body Enterprises Pty Ltd.
The 2010 National Fat-Loss-A-Thon Competition participant scores are confidential and will not be disclosed.
Each 2010 National Fat-Loss-A-Thon Competition participant assumes all risk of injury, harm or loss of any kind arising from participation in the said competition.
Real Body Enterprises recommends you consult with your physician or health care provider before starting any new exercise, nutrition or supplementation program, particularly if you suffer from any medical condition or regularly use prescription or over-the-counter medications. If you are not experienced with strength training, or if you are changing your exercise program, consult with a qualified trainer or coach.
The 2010 National Fat-Loss-A-Thon Competition participants must notify Real Body Enterprises Pty Ltd in writing of any change of address or phone number.
Potential Winners who cannot be reached within five (5) days at the address or phone number in their completed On-line Competition Entry Form will be disqualified.
As individuals differ, their results will differ, even when using the same program.
A completed On-line Competition Entry Form for the 2010 National Fat-Loss-A-Thon Competition constitutes permission to Real Body Enterprises Pty Ltd and their affiliated companies and their agencies to use winner’s name, likeness, and submission, in any form, in whole or in part, for purposes of public relations, promotional advertising and trade purposes in any and all media, without territorial, time, use or other limitation without further compensation, unless prohibited by law. All material submitted becomes the sole property of Real Body Enterprises Pty Ltd and will not be returned. Real Body Enterprises Pty Ltd is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize.
Prizes and Approximate Retail Values
- One 1st Prize Winner will receive $5000 cash, a 1 year full subscription to www.RealBodyClub.com, 2 x books (The Real Body plan & The Real Body recipe book), A bootcamp voucher for a famous Consort Fitness bootcamps which runs for 12 sessions over 4 weeks, 3 sessions per week and is valued at $229. Starting times for next year can be found on their website at www.consortfitness.com.au (this prize is transferrable if the winner does not reside close enough to utilise the prize). Approximate Retail Value [“ARV”] of 1st prize: AUD $5749.
- One 2nd Prize Winner will receive $2500 cash, a 1 year full subscription to www.RealBodyClub.com, 2 x books (The Real Body plan & The Real Body recipe book). Approximate Retail Value [“ARV”] of 2nd prize: AUD $3020.
- One 3rd Prize Winner will receive $1250 cash, a 1 year full subscription to www.RealBodyClub.com, 2 x books (The Real Body plan & The Real Body recipe book). Approximate Retail Value [“ARV”] of 3rd prize: AUD $1770.
- One 1st Prize Group Entry will receive up to 6 x 1 year full subscriptions to www.RealBodyClub.com, 6 x 2 books (The Real Body plan & The Real Body recipe book). Approximate Retail Value [“ARV”] of 1st Prize Group Entry: AUD $3100.
Non-monetary prizes cannot be redeemed for cash.
Limit one prize per person. No substitution or transfer of prize permitted. Real Body Enterprises Pty Ltd reserves the right to substitute prize of equal or greater value or to substitute the cash equivalent of the prize at its sole discretion.
All federal, state, and local taxes are the sole responsibility of winner.
Winners may be asked to become exclusive endorsers for Real Body Enterprises Pty Ltd products and services, and enter into an exclusive endorsement agreement. Acceptance is at the sole discretion of the winners.
Arbitration and Choice of Law
Except where prohibited by law, as a condition of participating in this contest, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the Federal, State or Local Arbitration Associations in Australia; (2) the Federal, State or Local Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction.
Under no circumstances will participants be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this contest), and participant further waives all rights to have damages multiplied or increased.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Real Body Enterprises Pty Ltd in connection with this contest, shall be governed by, and construed in accordance with, the substantive laws of Australia.
